Applicable To: All websites, platforms, and services operated by Tech Wynk IT Solutions LLP

Please read these Terms & Conditions (‘Terms’) carefully before using any website, platform, or service operated by Tech Wynk IT Solutions LLP and its brands. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2.1  Definitions

  • “Company” / “We” / “Us” means Tech Wynk IT Solutions LLP, registered in India, and includes all its brands: Xpertised, AreUCertified, Wynk Agency, Wynk Jobs, and NestLocate.
  • “User” / “You” means any individual or entity accessing or using any of our platforms or services.
  • “Platform” means any website, mobile app, or digital product operated by the Company.
  • “Content” means any text, images, videos, data, job listings, property listings, course material, assessments, or other material available on our Platforms.
  • “Services” means IT solutions, digital marketing, staffing, job portal, learning & assessment, and real estate SaaS services provided by the Company.

2.2  Eligibility

  • You must be at least 18 years of age to use our platforms.
  • Employers and businesses must be duly registered entities with the authority to post jobs, engage staffing services, or list properties.
  • By creating an account, you represent that all information provided is accurate and that you have the legal capacity to enter into binding agreements.

2.3  Account Registration & Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately at contact@techwynk.com if you suspect unauthorised access to your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.
  • You may not share, sell, or transfer your account to any third party.

2.4  Platform-Specific Terms

  1. a) Wynk Jobs (wynkjobs.com)
  • Job Seekers: By uploading your resume or applying for a job, you authorise us to share your profile with relevant employers on the platform.
  • Employers: You warrant that all job listings are genuine, lawful, and comply with applicable employment laws including the Equal Remuneration Act and any state-specific labour laws.
  • We do not guarantee employment outcomes or interview selections.
  • Employer subscription and posting fees are governed by the Refund & Cancellation Policy (Section 5).
  • Scraping, data mining, or automated access to Wynk Jobs without prior written permission is strictly prohibited.
  1. b) Xpertised (xpertised.com)
  • Course content is protected by copyright. Reproduction, redistribution, or resale without written authorisation is prohibited.
  • Certificates issued by Xpertised reflect completion of our course curriculum and do not constitute professional licensure unless specifically stated.
  • Access to paid courses is granted to the individual purchaser only and is non-transferable.
  1. c) AreUCertified (areucertified.com)
  • All assessments must be completed by the registered candidate personally. Any form of impersonation or proxy-testing is a violation of these Terms and may result in permanent disqualification.
  • Assessment results and certificates are the intellectual property of AreUCertified. Results may be verified by institutions via our verification portal.
  • Fees paid for assessments are non-refundable once the test session has commenced.
  1. d) NestLocate (nestlocate.com)
  • Property listings are posted by third-party agents, builders, and owners. Tech Wynk IT Solutions LLP does not own, sell, or represent any property listed.
  • We do not guarantee the accuracy, availability, or legal status of any property. Users must conduct independent due diligence.
  • Any transaction between buyers and sellers/agents occurs directly. We are not a party to such transactions.
  1. e) Wynk Agency & Tech Wynk IT Solutions (Digital Marketing & IT Services)
  • Service-specific terms are defined in individual Statements of Work (SOW) or service agreements signed with each client.
  • These Terms apply in addition to any such agreements.

2.5  Acceptable Use Policy

You agree not to:

  • Use our platforms for any unlawful, fraudulent, or harmful purpose
  • Post false, misleading, discriminatory, defamatory, or offensive content
  • Upload malware, viruses, or any code designed to disrupt our services
  • Harvest or collect other users’ personal data without their consent
  • Circumvent any access controls, geo-restrictions, or security measures
  • Use our platforms to send unsolicited commercial communications (spam)
  • Impersonate any person, organisation, or brand

2.6  Intellectual Property

All content, trademarks, logos, software, and databases on our Platforms are owned by or licensed to Tech Wynk IT Solutions LLP. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted. See Section 6 for our full Intellectual Property & Brand Notice.

2.7  Third-Party Links & Services

Our platforms may contain links to third-party websites or integrate third-party tools (e.g., Google Maps, payment gateways). We are not responsible for the content, privacy practices, or availability of such third-party services. Your use of third-party services is subject to their respective terms and policies.

2.8  Service Availability & Modifications

  • We aim for high availability but do not guarantee uninterrupted access to our platforms.
  • We reserve the right to modify, suspend, or discontinue any feature or service at any time with reasonable notice.
  • Planned maintenance will be communicated in advance wherever possible.

2.9  Limitation of Liability

  • To the maximum extent permitted by law, Tech Wynk IT Solutions LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you to us in the 3 months preceding the claim.
  • We are not liable for employment outcomes, property transactions, investment decisions, or any loss arising from reliance on platform content.

2.10  Indemnification

You agree to indemnify, defend, and hold harmless Tech Wynk IT Solutions LLP, its partners, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising out of your use of our platforms, violation of these Terms, or infringement of any third-party rights.

2.11  Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.
  • Any dispute shall first be attempted to be resolved through good-faith negotiation within 30 days.
  • Unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
  • Consumer disputes may also be raised with the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.

2.12  Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after the effective date of changes constitutes your acceptance.
