Tech Wynk IT Solutions LLP (“Tech Wynk,” “We,” “Us,” or “Our”) is committed to protecting the privacy and personal data of every individual who visits or uses our websites, platforms, and services. This Privacy Policy describes how we collect, use, store, share, and protect your information in accordance with the Information Technology Act, 2000 (as amended), the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023 (DPDPA).

- Learners and instructors using Xpertised (xpertised.com)
- Test-takers and institutions using AreUCertified (areucertified.com)
- Property seekers and agents using NestLocate (nestlocate.com)
- Clients and partners engaging with Tech Wynk IT Solutions or Wynk Agency
- Candidates and employees whose resumes or details are submitted through our staffing services
1.2 Information We Collect
- a) Information You Provide Directly
- Identity data: Full name, date of birth, gender
- Contact data: Email address, phone number, residential or billing address
- Professional data: Resume / CV, work history, education, certifications, skills, salary expectations
- Account data: Username, password (hashed), profile photo
- Property data (NestLocate): Property listings, location details, price, images, amenities
- Assessment data (AreUCertified): Scores, responses, certificates, attempt logs
- Payment data: Billing name, GST number, invoice preferences (payment card data is processed by PCI-DSS-compliant third-party gateways; we do not store raw card numbers)
- Communication data: Enquiry forms, chat messages, support tickets, emails
- b) Information We Collect Automatically
- Device & browser data: IP address, browser type and version, operating system, device identifiers
- Usage data: Pages visited, time on page, click paths, search queries, job applications submitted
- Location data: Approximate geographic location derived from IP address (precise GPS only if you grant permission)

- c) Information We Receive from Third Parties
- Social login data: If you sign in via Google, LinkedIn, or another OAuth provider, we receive your name, email, and profile picture as shared by that provider
- Job board feeds: Employer job listings sourced from official API partnerships (Indeed Publisher, LinkedIn Jobs API, ATS integrations)
- Background verification: With your explicit consent, we may receive results from third-party verification agencies
1.3 How We Use Your Information
- To create and manage your account on any of our platforms
- To match job seekers with relevant job opportunities on Wynk Jobs
- To process applications, communicate with employers and candidates, and manage interview pipelines
- To deliver online courses, assessments, and certification services
- To display and manage property listings on NestLocate
- To process payments, generate GST-compliant invoices, and maintain financial records
- To send transactional emails and SMS (OTP, application updates, booking confirmations)
- To send marketing communications where you have opted in — you may opt out at any time
- To improve platform performance, fix bugs, and personalise your experience
- To detect, prevent, and investigate fraud, abuse, or illegal activity
- To comply with applicable laws, court orders, and regulatory requirements
1.4 Legal Bases for Processing
- Consent: Where you have given explicit consent (e.g., marketing emails, cookie tracking, background checks)
- Contractual necessity: To fulfil obligations under our Terms & Conditions or a service agreement
- Legitimate interests: For platform security, analytics, and service improvement, provided these do not override your rights
- Legal obligation: Where required by Indian law or a competent authority
1.5 Sharing Your Information
We do not sell your personal data. We may share it with:
- Employers and recruiters on Wynk Jobs — only the data you choose to make visible in your profile or application
- Property developers, agents, and buyers on NestLocate — only listing data you have published
- Service providers: Cloud hosting (Cloudways/AWS), email (Amazon SES), payment gateways (Stripe, Razorpay), analytics, and SMS providers — bound by data processing agreements
- Group companies and brands: Xpertised, AreUCertified, Wynk Agency, Wynk Jobs, NestLocate — all operated under Tech Wynk IT Solutions LLP
- Legal and regulatory authorities: As required by law, court order, or government directive
- Business transfers: In the event of a merger, acquisition, or sale of assets, personal data may be transferred subject to equivalent protections
1.6 Data Retention
- Active account data is retained for the duration of your account plus 3 years after closure
- Job application records are retained for 2 years
- Assessment and certification records are retained for 5 years
- Financial and billing records are retained for 8 years as required by Indian tax law
- Inactive accounts with no logins for 3 years may be archived or purged after notice
1.7 Your Rights (DPDPA 2023)
You have the right to:
- Access: Request a copy of the personal data we hold about you
- Correction: Request correction of inaccurate or incomplete data
- Erasure: Request deletion of your personal data (subject to legal retention obligations)
- Withdrawal of Consent: Withdraw consent at any time without affecting past processing
- Grievance Redressal: Contact our Grievance Officer (details in Section 1.10) with any complaint

1.8 Data Security
- All data in transit is encrypted using TLS 1.2 / TLS 1.3
- Passwords are stored using bcrypt hashing
- Access to personal data is restricted to authorised personnel on a need-to-know basis
- We conduct periodic security assessments and vulnerability testing
- In the event of a data breach affecting your rights, we will notify you and the Data Protection Board (once operational) within the timelines prescribed by DPDPA 2023
1.9 Children’s Privacy
Our platforms are not directed at children under 18 years of age. We do not knowingly collect personal data from minors. If you believe a minor has provided us data, please contact our Grievance Officer immediately.
